US Work Visas
FLEXIBLE, BUT LIMITED IN NUMBER
H-1B Visa
Flexible visa for a wide-range of work. Your employee can use H-1B for nearly any job that requires a Bachelor's degree at a minimum. Because of their popularity, every year a lottery is held starting around April 1st. Sometimes there are multiple rounds. If your petition is chosen, your employee can begin work October 1st. While new H-1Bs can unfortunately not obtain a visa outside of these timelines, workers who already have H-1Bs can switch employers any time of year.
WORK PERMISSION AS LONG AS YOUR BUSINESS LASTS
E-2 Investor Visa
If you want to start a business in the US, you can obtain this multi-year visa and renew it for as many years as your business continues to trade and be profitable. Obtaining it requires a showing that your business is owned by individuals or entities of a certain nationality; and that you have spent a substantial sum of money in setting up the business. Your business should be ready to trade before you apply. This visa allows you to stay many years in the US, but never directly leads to a green card.
AVAILABLE THROUGHOUT THE YEAR
L-1A or L-1B Visa
The L-1A for Executives and Managers and L-1B for Specialized Knowledge visas are for Intracompany Transferees. Your employee must have worked for one of your entities abroad for at least one year before applying. Executives must show they make high-level decisions, while managers must show multiple levels of employees underneath them. Specialized Knowledge must be related to the company's product, service, research, equipment, techniques, management, or other interests.
