Multi-National Manager
Following on well from a previous L-1A petition, this type of Immigrant Visa gives an Executive or Manager permanent permission to live in the US. If the employee is already in the US, they can choose to do in-country processing (AOS). The case can also be strategized to preserve their ability to travel internationally during the process - whatever suits your business needs.
LABOR CERTIFICATION
EB-2 & EB-3 PERM for All Other Workers
Employees whose background or jobs mean they are ineligible for EB-1 petitions still often have a path to a green card. PERM Labor Certification is the process by which they can achieve it. The process involves testing the labor market to prove there are no qualified US workers who can occupy your job opening. Although the process is long (generally at least 2 years), with good strategizing at the start, it ends with a green card and is well worth it.
EB-2 SELF-PETITIONING
National Interest Waiver
The PERM process can be avoided for workers with advanced degrees, or having Exceptional Ability. This requires a showing that the area of work has substantial merit and is of national importance to the US. The applicant need not be sponsored by an employer, and can skip the PERM process, but must show they are well-placed to advance their field.
EB-1A
Extradordinary Ability
For people who have achieved national or international recognition for their achievements in the sciences, arts, education, business, or athletics. Obtaining this type of green card requires a bank of third-party evidence proving a degree of skill and reputation substantially above that ordinarily encountered. This is done with proof of the receipt of an extremely high-level award, such as an Oscar, or else by providing proof the applicant meets at least 3 of 10 specific criteria.
EB-1B
Outstanding Researcher or Professor
With a tenure or tenure-track job offer from a US employer, a green card can be obtained on a relatively fast timeline for researchers and academics. This requires a showing of at least 3 years of experience in teaching or researching in the area of expertise, as well as evidence meeting at least 2 of 6 specific criteria.
EB-5
Investor Green Card
This program offers you a green card in exchange for investment and job creation in the US. You must start, and run, a new commercial enterprise that creates at least 10 full-time jobs for American workers. Requires investment of $1.05 M, or $800 K in a "targeted employment area."
